Contest Rules:

  • Entrant must be 18 years of age or older.
  • Winner need not be present to win.
  • Winner will be selected December 5th 2009. If less than 1000 tickets are sold, we reserve the right to extend the drawing date
    or refund your entry fee.
  • All drawings will be random and will be supervised by an authorized, non-ACVOW member.
  • All prizes must be picked up by the winner within one week of the drawing.
  • If any winner(s) does not claim their prize within the allotted time of one week, and they are unable to be located, there will be
    a second entry drawn.
  • Once submitted, entries become the sole property of ACVOW and will not be returned. Acceptance of a prize constitutes
    winner’s permission for ACVOW to use winner’s name for publicity purposes without further compensation.
  • Winner must have a valid state driver's license or identification card with picture in order for ACVOW to release the prize.
  • If a credit card charge for a raffle ticket is rejected or denied or a personal check is returned for non-sufficient funds and the
    purchasing/responsible party does not provide cash payment (with processing fees $10.00) no later than 14 days prior to
    drawing, the sold ticket number will be removed from the raffle drawing ticket pile.
  • Once an individual winner’s raffle ticket is selected as a prize winner, that ticket is removed so that it cannot be in succeeding
    cash prize drawings if further drawings take place.  For example, the Grand Prize winning ticket will be withdrawn so it cannot
    be used in the 2nd, 3rd, or 4th place cash prize drawings.
  • All prize winners shall be responsible for payment of any income or sales tax associated with such prize, as well as all
    maintenance, insurance, title, registration and license costs or fees associated with, and all costs and fees for changes and
    upgrades to, such automobile. Winner must also execute any documents necessary to take title to such prizes.
  • Due to the nonprofit status of ACVOW there cannot be a cash substitution for the prize or prizes being awarded.
  • All winner(s) will be notified by phone or in writing of what they have won and how to claim the prize. Names of potential
    winners will also be made available on the ACVOW website at www.acvow.org.  Only those named as the entrant on a valid
    winning entry form are eligible to claim a prize, and such persons will be required to provide proof of identification acceptable
    to ACVOW.
  • In the event of a winning entry having more than one name, the prize will be awarded to the first name listed on the entry.

All winner(s) of any prize(s) are subject to all applicable raffle procedures, restrictions, rules, directives, state and local laws and
regulations and are solely responsible for all federal, state and local taxes, fees, assessments, charges, license, title, registration, fees
and assessments associated with the prize(s).

The IRS requires that income taxes on prizes values of $5,000 or greater must be paid upon award, and before prize distribution.
ACVOW members and employees assume no liability for damages loss or theft of prizes once awarded.

It is agreed by all Winner(s) as a condition of winning any prize that in no case shall ACVOW or its members, employees or affiliates be
liable for any claims, liabilities or costs of any kind, nature or character resulting from acceptance, possession, or use of any prize.
ACVOW makes no claim regarding the actual value of any prize and do not take any responsibility for the accuracy of any estimates.
The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar drawings for valuable prizes
are not donations or gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution. Check with your
tax professional for additional information.

It is understood by all entry participants that raffle tickets will be sold up to and including the day of the raffle, which is December 5th,
2009.  Raffle sales will close once the announcement has been made at the Safe Warrior Reception.

Governing Law/Jurisdiction

All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules or the rights and
obligations of entrants or sponsor in connection with the raffle shall be governed by and construed in accordance with the internal laws
of the State of California without giving effect to any choice of law of conflict of law rules or provisions that would cause the
application of any other state’s laws. The invalidity or unenforceability of any provision of these rules shall not affect the validity or
enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal,
these rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision
were not contained herein. Each person who participates in the raffle irrevocably agrees that the state courts located in San Diego
County, California shall have exclusive jurisdiction over any suit or other proceeding arising out of or based upon this agreement, and
each hereby waives any claim that it is not subject personally to the jurisdiction of said courts or that any such suit or other proceeding
is brought in an inconvenient forum or improper venue. This raffle is void where prohibited by law.
